1. About the Service

EventPhotoId is a web-based platform designed to help participants find, view, and access photographs taken during events.

The Service may provide several methods for finding photographs, including:

• Name or participant information
• Bib or race number
• Event information
• Photo matching
• Facial photo matching
• Other search features made available by the event organiser or EventPhotoId

2. Eligibility

You may use the Service if you are legally permitted to enter into these Terms under the laws applicable to you.

If you are under the age required to provide consent under applicable law, you should only use the Service with the involvement and permission of a parent, guardian, or other legally authorised person where required.

3. Use of the Photo-Matching Feature

EventPhotoId may offer an optional photo-matching feature that allows you to upload a photograph or selfie to help locate your event photographs.

By using this feature, you acknowledge and agree that:

• The uploaded photograph may be temporarily processed by our technology for photo matching.
• The matching process is used solely to identify photographs that may correspond to the uploaded photograph.
• The matching process does not constitute official identity verification.
• Matching results are generated automatically and may not always be accurate.
• You should not rely on the matching feature for identity verification, security, legal, medical, financial, or other high-risk purposes.
• The submitted photograph and facial-matching information are handled in accordance with our Privacy Policy.

4. Accuracy of Matching Results

Photo matching is a technology-assisted search function and may produce incorrect, incomplete, or irrelevant results.

A photograph may be identified as a possible match even when it does not contain the person who submitted the search image. Similarly, photographs containing the user may not always be identified.

EventPhotoId does not guarantee that:

• All photographs of a participant will be identified;
• Every search result will be accurate;
• A particular photograph will be available;
• The Service will correctly identify every individual appearing in an image; or
• The photo-matching feature will always be available.

5. Event Photographs

Photographs available through EventPhotoId may be captured by professional photographers, event photographers, photography partners, or other authorised parties.

Photographs may contain multiple people, including participants, spectators, staff, volunteers, or other individuals present at the event.

EventPhotoId does not necessarily own the copyright or other intellectual property rights in photographs displayed through the Service.

The applicable copyright and usage rights may belong to the event organiser, photographer, photography company, or other rights holder.

6. Use of Photographs

Unless otherwise stated, photographs accessed through EventPhotoId are provided for personal, non-commercial use.

You may download or save photographs where the Service provides such functionality, subject to any restrictions imposed by the relevant event organiser, photographer, or rights holder.

You must not, without appropriate permission:

• Sell or commercially redistribute photographs;
• Use photographs in advertising or commercial campaigns;
• Remove copyright notices, watermarks, or other ownership information;
• Claim ownership of photographs created by another person;
• Use photographs to impersonate another person;
• Modify photographs in a way that misrepresents the original event or subject;
• Use photographs for unlawful purposes; or
• Systematically download, scrape, copy, or reproduce large quantities of photographs.

7. User-Submitted Photos

If you upload a photograph, selfie, or other image to use the Service, you represent that:

• You have the right or appropriate permission to submit the image;
• Your submission does not knowingly violate another person's rights;
• You are not using the Service to unlawfully identify, monitor, or track another person; and
• The submission complies with these Terms and applicable laws.

8. Prohibited Activities

You agree not to use the Service to:

• Violate any applicable law or regulation;
• Access another person's private information without authorisation;
• Attempt to identify or track individuals for purposes unrelated to locating event photographs;
• Upload images that contain malicious code or harmful content;
• Interfere with the operation or security of the Service;
• Attempt to gain unauthorised access to our systems;
• Scrape, crawl, harvest, or systematically collect data or photographs from the platform;
• Circumvent access controls, download restrictions, or security mechanisms;
• Reverse engineer, decompile, or attempt to extract the source code of the Service except where permitted by applicable law;
• Use automated systems to access the Service without our prior written permission;
• Use the Service to harass, threaten, stalk, or otherwise harm another person;
• Upload content that infringes another person's intellectual property, privacy, or other legal rights; or
• Use the photo-matching technology as a general-purpose facial-recognition or identification system.

9. Intellectual Property

The EventPhotoId name, logo, website design, software, technology, user interface, text, graphics, and other original materials associated with the Service are owned by or licensed to EventPhotoId and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not reproduce, modify, distribute, publicly display, sell, license, or create derivative works from EventPhotoId's intellectual property without prior written permission.

Event photographs remain subject to the ownership and licensing rights of their respective photographers, event organisers, or other rights holders.

10. Third-Party Services

EventPhotoId may use third-party services to provide hosting, cloud infrastructure, image processing, photo storage, analytics, security, payment processing, or other functionality.

Some features may therefore depend on third-party systems.

We are not responsible for interruptions, failures, or changes to third-party services that are outside our reasonable control.

11. Service Availability

We aim to keep EventPhotoId available and reliable, but we do not guarantee that the Service will always be:

• Available;
• Uninterrupted;
• Error-free;
• Secure from every possible threat; or
• Free from technical defects.

12. Event-Specific Information

Information relating to a particular event, including event schedules, participant data, photography coverage, photo availability, download options, pricing, and access restrictions, may be determined by the relevant event organiser or photography provider.

EventPhotoId may provide the technical platform for such services but may not be responsible for the underlying event, registration, race results, event operations, or photography coverage.

For event-specific questions, you may need to contact the relevant event organiser or photography provider.

13. Privacy

Your use of the Service is also subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, process, store, and protect personal information, including information associated with our optional photo-matching feature.

By using the Service, you acknowledge that you have read our Privacy Policy.

14. Disclaimer

To the maximum extent permitted by applicable law, the Service is provided on an "as is" and "as available" basis.

EventPhotoId does not guarantee that the Service will meet your specific requirements or that all photographs you are looking for will be available.

We are not responsible for:

• Missing or incomplete event photographs;
• Incorrect photo-matching results;
• Poor image quality caused by the original photography;
• Photographs not captured by event photographers;
• Incorrect participant information supplied by event organisers or third parties;
• Temporary or permanent service interruptions;
• Loss caused by unauthorised use of your account or access credentials; or
• Problems caused by third-party services beyond our reasonable control.

15. Limitation of Liability

To the maximum extent permitted by applicable law, EventPhotoId and its owners, employees, contractors, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

Where liability cannot be excluded, our liability will be limited to the maximum extent permitted by applicable law.

Nothing in these Terms is intended to exclude statutory rights or protections that cannot legally be excluded.

16. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless EventPhotoId and its owners, employees, contractors, affiliates, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:

• Your violation of these Terms;
• Your misuse of the Service;
• Your violation of another person's rights;
• Content or images you submit to the Service; or
• Your violation of applicable laws or regulations.

17. Suspension and Termination

We may suspend or terminate your access to the Service if:

• You violate these Terms;
• You misuse the Service;
• Your use creates a security or legal risk;
• We are required to do so by law; or
• We discontinue or materially change the Service.

18. Changes to the Service

We may modify, suspend, or discontinue any part of the Service at any time.

We may also introduce new features, remove existing features, or change how certain functionality operates.

Where appropriate, we may provide notice of significant changes.

19. Changes to These Terms

We may update these Terms from time to time.

When we make changes, we will update the "Last Updated" date at the top of this page.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.

20. Governing Law

These Terms are governed by the laws of the Republic of Indonesia, unless applicable law requires otherwise.

Any dispute arising from or relating to these Terms or the Service shall be subject to the applicable jurisdiction of the courts of the Republic of Indonesia.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will remain in full force and effect.

The invalid or unenforceable provision will be interpreted or replaced to the extent necessary to achieve its intended purpose while remaining consistent with applicable law.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other policies or terms specifically referenced by the Service, constitute the agreement between you and EventPhotoId regarding your use of the Service.
